Can I sponsor someone if their VISA has expired already?

A new VISA application should generally be submitted to the Home Office on or before the expiry date of the current VISA. If a new VISA application is not submitted before or on the expiry date the Home Office usually inform you that you have 60 days to find a new sponsor or leave the country.

While you can submit a new VISA application during these 60 days, the application will require more information to explain why a new application was not made on or before the VISA expiry date.

You are not allowed to work after your VISA has expired, and will not be allowed to work until the new VISA has been approved by the Home Office.

We therefore recommend making sure that your new VISA application is ready to be submitted before your current VISA expires, and that any sponsorship offers are made 2-3 months before the current VISA expires.
