Before you can terminate an employee’s Skilled Worker visa sponsorship, there are several important steps you must follow to remain compliant with Home Office requirements.

1️⃣ Report the Change of Circumstance

You must first report the termination as a change of circumstance so our immigration team can notify the Home Office.

2️⃣ Terminate the Sponsorship in Borderless

Once the change of circumstance has been submitted, you can proceed with terminating the sponsorship by:

  1. Go to the Employees tab.

  2. Select the employee’s profile.

  3. Click "Remove Employee".

  4. Fill in the details and submit.

💰 Partial Immigration Skills Charge (ISC) Refund

If sponsorship ends earlier than the CoS start/end date:

  • A partial refund of the Immigration Skills Charge (ISC) may apply.

  • This refund is automatically triggered when you terminate sponsorship in Borderless.

  • The refund will be sent to the account that originally paid the ISC.

📌 Example: If Borderless assigned the CoS, we will receive the refund from the Home Office and then pass it on to you. It can take up to 6 months for the Home Office to process ISC refunds.

⚠️ Important Notes

  • You must report the change of circumstance before removing the employee.

  • The employee will no longer be allowed to work in the UK once sponsorship is terminated, unless they obtain a new visa or sponsorship.

  • Failure to follow the correct process may result in Home Office compliance issues.
