A guide for employers on conducting Right to Work Checks with eVisas

Due to the Home Office is phasing out physical Biometric Residence Permit (BRP) cards, on 31 December 2024, there has been an introduction of eVisas as the new standard for proving immigration status.

The eVisa is the electronic equivalent of a BRP card. While employers are not required to retain copies of the eVisa, it's essential to conduct a Right to Work Check (RTWC) to verify that the individual has the legal right to live and work in the UK.

How to Conduct a Right to Work Check with the eVisa:

  1. Generate a Share Code

    The employee must generate a share code using this link. Once they've obtained the code, they'll share it with you for the verification process.

  2. Verify the Employee's Right to Work

    Use the share code and the employee's date of birth on this link to verify their right to work.

  3. Record the Result in Borderless

    From 8 April 2026, the Right to Work check is built into the sponsorship offer flow in Borderless. When you reach the Right to Work step in the offer form, the platform will prompt you to enter the share code and the worker's date of birth and will validate the result directly. You do not need to navigate to the government site separately β€” the check runs within the platform.

    If the sponsorship offer has already been submitted and you need to upload supporting evidence (for example a screenshot of the share code result), go to the employment record on the individual's profile and use the document upload there. The document sub-type selector lets you specify whether you are uploading a share code result, manual check evidence, or an ECS Positive Verification Notice.

What's Changed?

While the underlying process for conducting RTW checks remains the same, the documentation format has changed. eVisas now replace BRP cards, but employers still need to:

  • You must conduct RTW checks before the employee begins working.

  • If a right to work check cannot be conducted, use the Employer Checking Service to verify the employee's Immigration status. In Borderless, if the share code check cannot be completed, the platform will surface the ECS pathway automatically within the offer form.

Compliance Reminder

There is no requirement to retain a copy of the eVisa for compliance purposes, but employers must retain evidence of the RTWC.
