Dependant Children Turning 18 During Sponsorship

Understanding what to do when a dependent child turns 18 during a visa application

Written by Tom Hext

Can a dependant child continue to extend their visa after turning 18?

Yes, in most cases. A child who was originally granted permission to remain in the UK as a dependant before turning 18 can continue to extend their visa as a dependant when the main applicant renews their sponsorship, provided they continue to meet the relevant dependency requirements.

The key conditions are that the child must not be leading an independent life, must still be financially dependent on the main visa holder, and must have been granted dependant permission before their 18th birthday. Turning 18 does not automatically disqualify a child from extending in this category.

Right to work for dependant children over 18

As a dependant visa holder, a child over 18 will have the right to work in the UK in most roles, subject to any restrictions stated on their visa. Employers should carry out a right to work check in the usual way when they begin employment.

What the employer needs to do

If the main sponsored worker is renewing their visa and has a dependant child who has turned 18, the employer should inform Borderless when the renewal is being processed. Our team will confirm that the dependant application is structured correctly and that the child's circumstances still meet the Home Office requirements for this category.
