Can a Sponsored Worker Perform Supplementary Duties Without Updating Their CoS?

Yes - a sponsored worker can be asked to carry out minor supplementary duties without changing their CoS, as long as the core responsibilities still match the job described on the CoS.

These minor adjustments do not need to be reported to the Home Office using the SMS.

βœ… What About Extra Work Outside the Main Role?

In addition to their main job, a Skilled Worker can do supplementary work if all the following conditions are met:

  • The job is in an occupation listed in Tables 1, 2, or 3 of Appendix Skilled Occupations

  • The extra work is no more than 20 hours per week

  • It is done outside the working hours stated on the CoS

πŸ†• As of 4 April 2024, this extra work does not need to be in the same profession or on the shortage occupation list - it just needs to be in one of the listed eligible occupations. This rule now applies to all Skilled Workers, even those sponsored before this date.

🩺 GP Trainees Exception

If the Skilled Worker is a GP trainee, they are allowed to do supplementary work during the 4 months following the end date on their CoS - even if they are no longer working for their sponsor. For all other workers, they must remain employed by their sponsor in order to take on any supplementary work.

If the supplementary job meets all of the above criteria, there’s no need to inform the Home Office or update the CoS. However, any substantial changes to job duties that fall outside the scope of the original CoS must be reported.
